    Claims Representatives
    1. The Insurer is required to appoint a Claims Representative in each Member State of European Economic Area (EEA) except the one in which an insurance licence was granted to the Insurer. The position of a Claims Representative may be filled with a natural person or a legal entity with a permanent residence or with a registered business address in the relevant Member State of the EEA.
    2. The Claims Representative processes claims for and on behalf of the Insurer and for the Insurer’s account; the Claims Representative can act in this capacity for and on behalf of one or several Insurers; the operations of a Claims Representative do not constitute the establishment of an Insurer’s branch.
    3. The Claims Representative gathers information necessary to examine the Injured party’s claims for indemnification and acts towards paying such claims if loss is inflicted by the operation of a motor vehicle,
      • in respect of which liability insurance was taken out in a Member State other than the one in which the Injured is a permanent resident or has a registered business address;
      • which typically stays in a Member State other than the one in which the Injured is permanently resident or has a registered business address;
      • on the territory of a Member State other than the one in which the Injured is permanent resident or has a registered business address.
    4. With regard to processing the Injured Party’s claims, the Claims Representative has the right to fully represent the Insurer and must provide for the examination of the Injured party’s claims in the official language of the Member State in which the Injured is a permanent resident or has a registered business address; this will be accomplished without a compromise to the right of the Injured to press claims for indemnification directly against the Insurer or the person who inflicted the loss.
